Noida Workers' Protest | Allahabad High Court Grants Bail To 'Mazdoor Bigul Dasta' Member In 2 FIRs

The Allahabad High Court recently granted bail to Himanshu Thakur, a member of the workers' union 'Mazdoor Bigul Dasta',�in connection with two FIRs arising from the April 2026 industrial workers' protest in Noida. Both FIRs, Case Crime Nos. 164 and 165 of 2026, concerned alleged mob violence at public places and companies in Gautam Buddha Nagar/Noida, where a large number of workers had allegedly gathered, engaged in stone-pelting and damaged public and company property. The FIRs were registered under several provisions of the BNS and Sections 3/4 of the Prevention of Damage to Public Property Act. The FIR no. 165 implicated a mob of around 450-500 persons; however, no specific role had been assigned to Applicant-Thakur. Bail orders In FIR no. 164, Justice Krishan Pahal granted bail to Thakur on August 7. Justice Pahal took note of the fact that a similarly placed co-accused, Ravi Kumar Rathore, had already been granted bail by a coordinate Bench of the High Court on June 24, 2026. It also noted that the criminal history attributed to Thakur stood explained. Thakur was directed to be released on bail on furnishing a personal bond and two sureties, subject to verification of the sureties. He was also directed not to tamper with evidence or intimidate witnesses and to appear before the trial court as required. On the other hand, in Case Crime No. 165, Justice Avnish Saxena granted bail to Thakur on August 20. Though the State opposed bail, alleging that he was instrumental in spreading violence through social media and had used the internet to spread hatred, the bench granted him bail, noting that no specific role was attributed to him. Thakur was directed to be released on bail on furnishing a personal bond and two sureties. He was also directed to cooperate with the judicial process for fair and speedy disposal of the case. Advocates Association Of Western India To Get Woman President, The First In Over A Century

In a first, Advocates Association of Western India (AAWI) a lawyers association in the Bombay High Court, will now get a Woman Advocate as its President, in its existence of 162 years.� This comes after AAWI amended its Constitution and Rules to reserve the post of its President for women lawyers. Confirming the development, senior advocate Deepa Chawan said that this is a significant development as it would help women lawyers to now lead one of the oldest Bar Associations in the country.� "In 162 years of AAWI we would have a women president at the helm it is almost like a pathbreaking building an equality... skewed ratio of women as members it's a big step towards equality.. Definitely a milestone for women... In 2018 itself AAWI had reserved ," Chawan said.� In an official statement issued by AAWI President Prashant Relekar, it has been resolved that the post of President would be reserved for woman lawyers.� "The AAWI, one of the oldest association of lawyers in India, established in 1864, has unanimously resolved to amend its Constitution and Rules to reserve the post of President — the highest office in its Executive Council — for women members, effective from the very next election. In its 162 years of existence, AAWI has never had a woman occupy the post of President. Today's decision marks a historic and long-overdue correction, ensuring that a woman member will lead the Association once in every three terms," an official statement from AAWI reads.� The resolution follows consideration of a report submitted by AAWI's Constitutional Amendment Committee, chaired by AAWI President Prashant Relekar, which was tasked with recommending amendments to broaden the participation of women in the Association's executive leadership. Grabbing & Pressing Woman's Shoulder, Shoving Her Away May Outrage Her Modesty; Not Sexual Harassment: Bombay High Court

The Bombay High Court recently held that a man's act of grabbing a woman's shoulder, pressing it and shoving her away, making her feel ashamed, may amount to outraging her modesty but the very act would not amount to sexual harassment as there is 'no sexual intent' or 'sexual overtures' or any unwelcome physical contact.� Single-judge Justice Abhay Mantri therefore partly quashed a First Information Report (FIR) lodged against one Girish Nigonda Patil, who was booked for barging into a Gram Panchayat office, quarrelling with the complainant female Block Development Officer (BDO), tearing some documents and then grabbing her shoulder, pressing it and shoving her away. The woman claimed that she felt ashamed by such a conduct of the petitioner.� Patil was therefore, booked under charges of assaulting a public servant (section 353), causing simple injury (section 323), outraging modesty of a woman (section 354) and sexual harassment (section 354-a) of the Indian Penal Code (IPC). The bench while perusing the material on record, prima facie, noted that the material indicated that the victim was doing her job in the Gram Panchayat office when the Petitioner entered into the office and quarrelled with her, and snatched the approval order, tore it up and threw it on the table. Thereafter, he grabbed and pressed her right shoulder and shoved her away after doing something that made her feel ashamed. "Thus, prima facie, it reveals that the Petitioner used assault or criminal force to deter her from discharging her duty as a public servant and also outraged her modesty, causing her to feel ashamed. The said averments themselves attract the ingredients of Sections 323, 353 and 354 of the IPC. However, prima facie, it does not appear that the Petitioner, with an intent to commit physical contact and advances involving unwelcome and explicit sexual overtures or a demand for sexual favours, as contemplated in Section 354-A of the IPC.
